I was fortunate to attend Hassan Shibly session at ICCD - Islamic Community Center of Des Plaines on "Court: Last Place You Want To Be". This session was very informative! It focused on measures to help avoid going to court regarding divorce, probate, business dispute, and personal and criminal liability. Amongst all topics, my focus was on divorce because there is a high divorce rate among Muslims in the US, and ugly divorce impacts children.
Hassan reminded us that believing men and women must follow Allah's social and economic rights law. I learned that divorce is the single biggest wealth destroyer in the US. Both men and women use US divorce laws to abuse each other, which impacts their children. Instead, at the time of nikkah, there should be clear clauses added by both parties and a legal contract created by an attorney that can be used if the marriage ends up in divorce. All this is to ensure that, eventually, the kids are least impacted. Otherwise, we know kids from broken families lead to many other social issues.
Hassan Shibly, I appreciate that as a civil rights attorney, you were focused on saving families, and if they decide to part ways, they follow a "halal" way and not get greedy just because the system allows it.
